Advocate General, Haryana. **** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner invokes inherent powers of this Court for issuance of a direction that his representation dated 22.10.2024 made to the Director, Mines and Geology Department, Chandigarh (Annexure P-3) regarding illegal mining of minor minerals i.e. sand and gravel, has been ignored by the concerned Mining Inspector/Officer, Yamuna Nagar and since the relevant rule i.e. Rule 106 of the Haryana Minor Mineral Concession, Stocking, Transportation of Minerals and Prevention of Illegal Mining Rules, 2012 (Amendment) Rules, 2012 empowers only the authorized officer and restricts the Court to take cognizance of any offence punishable under these rules except upon a complaint in writing made by the Director or any other officer authorized by him to the police in this behalf and therefore, the petitioner has been compelled to approach this Court.

In view of the above, the Mining Officer of the concerned area is directed to consider the representation of the petitioner (Annexure P-3) and decide the same within a period of one week from the date of receipt of a copy of this order and take appropriate steps in accordance with law and if no mining offence as alleged is found, then a reasoned order be passed within a further period of 15 days assigning cause for denial and communicated to the petitioner.
