This is the third petition, whereby, the petitioner has sought the relief of him being granted the concession of anticipatory bail in FIR No.117 dated 07.10.2023, under Sections 307/452/323/427/506/148/149 of the IPC, and, Section 25 of the Arms Act, registered at P.S. City Nakodar, District Jalandhar (Rural).

The initial petition, i.e. CRM-M-58512-2023, wherein, the petitioner had sought an alike relief, as claimed herein, was dismissed as withdrawn by this Court, vide order dated 20.11.2023. However, petitioner was granted liberty to surrender before the learned trial Court within seven days and direction was also given to the latter to, in case the petitioner prefers any regular bail application, decide the same expeditiously.

Thereafter, the petitioner again approached this Court, through filing CRM-M-11571-2024, thereby again seeking relief alike to the one yearned herein, however, the said petition was also dismissed as withdrawn by this Court, vide order dated 05.03.2024. 4.

Now, after addressing arguments for some time, the learned counsel for the petitioner seeks leave to withdraw the instant petition, however, with liberty to the petitioner to, in pursuance to the order dated 20.11.2023, surrender before the learned trial Court concerned and to make an application for bail before the latter, which may be directed to be decided expeditiously, inasmuch as, the matter has been compromised between the parties.

Consequently, the instant petition is dismissed as withdrawn, however, with liberty to the petitioner to, within 07 days from today, surrender before the learned trial Court concerned, and thereupon, if he makes an application before the latter for grant of bail, the latter shall decide the same within two days, but, after affording opportunity of hearing to the opposite party.
