CRM-M-55764 of 2019 Through the instant petition, the petitioners seek anticipatory bail in case FIR No.519 dated 21.12.2019 registered under Sections 148, 149, 323, 427, 452 and 506 of Indian Penal Code, 1860, however, Section 325 IPC was added later on, at Police Station Gannaur, District Sonipat (Annexure P-1).

CRM-M-55764 of 2019 (O&M) {2} "Learned counsel for the petitioners has contended that only allegation against the petitioners is that they gave a lalkara. List this matter on 28.02.2020.

Meanwhile, the petitioners shall join the investigation and would come present as and when called for and in the event of arrest, the petitioners shall be admitted to interim bail on their furnishing personal and surety bonds to the satisfaction of Arresting Investigating Officer.The petitioners shall also abide by the conditions as specified under Section 438(2) Cr.P.C." Learned State counsel, on instructions from ASI Prem Parkash submits that the petitioners have joined investigation and are no longer required for custodial interrogation. He has further instructions to state that the petitioners are not involved in any other criminal case. In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 08.01.2020 granting interim bail to the petitioners is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
