***** RAJ MOHAN SINGH, J .(Oral) The petitioner seeks grant of anticipatory bail in case bearing FIR No.502 dated 27.09.2019 registered under Sections 420, 406 and 506 of Indian Penal Code at Police Station City, Fatehabad, Haryana.

On 03.01.2020, following order was passed:- "Inter alia contends that the petitioner has not been named in the FIR, which is against his father Malkiat Singh and the basis of disclosure statement of his father he has been roped in. The said accused has already been released on bail on 20.12.2019 by the Chief Judicial Magistrate, Fatehabad.

CRM-M No. 55760 of 2019 (O&M) -2Notice of motion to the respondent be issued for 27.02.2020.

In the meantime, it is directed that the petitioner shall join investigation and in the event of arrest of the petitioner, he shall be released on ad-interim bail by the investigating officer. The petitioner shall join investigation as and when required and shall comply with the conditions laid down in Section 438 (2) Cr.P.C."

Evidently the petitioner has not been named in the FIR. He has been nominated on the basis of disclosure statement of his father. His father has been released on bail by the Chief Judicial Magistrate, Fatehabad.

Learned State counsel on instructions from ASI Jai Singh states that the petitioner has joined the investigation and is not required for any further investigation of the case. In view of the statement made by learned State counsel, order dated 03.01.2020 passed by the Coordinate Bench is made absolute, however petitioner shall abide by the conditions as envisaged under Section 438 (2) Cr.P.C. Petition stands disposed of.
