Learned counsel for the petitioner submits that in the impugned order (Annexure P-13) itself, the respondents have mentioned that the post in question has become vacant but the claim of the petitioner has not been considered for appointment which is causing prejudice to him. 2.

On the asking of the Court, Mr. Pankaj Middha, Additional Advocate General, Haryana, who is present in Court, accepts notice on behalf of the respondent-State and submits that there are number of posts which have become available/vacant with the department concerned and need to be filled up and as per the instructions received from the department concerned, hence, appropriate decision/action will be taken within a period of four weeks from today as to how, the posts which have become available are to be dealt with and in case, it is found that the said remaining posts are to be filled from the candidate already in the waiting list, appropriate action will be taken so as to give them appointment. 4.
