The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking setting aside of order dated 10.09.2012 (Annexure P-1) whereby the order for recovery was passed. 2.

The petitioner was working with respondent as ASI and he retired on 30.04.2018. During his service tenure, the respondent issued recovery notice dated 10.09.2012. Pursuant to recovery notice, a sum of Rs.52,888/- was recovered from him. The petitioner while in service did not challenge recovery notice whereas after retirement, he filed CWP No.19517 of 2018 before this Court which was withdrawn. After withdrawal of writ petition, the petitioner served legal notice dated 03.11.2022 upon the respondents and through instant petition, the petitioner is seeking setting aside of recovery notice dated 10.09.2012.

The respondent recovered a sum of Rs.52,888/- from the petitioner in 2012. The petitioner was in service till 2018 and remained silent. The petitioner post retirement has started raising the issue. 4.

Considering the amount involved as well as length of delay, this Court does not find it appropriate to invoke its writ jurisdiction. 5.

The petition stands dismissed.
