The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of dismissal order dated 02.02.2023 as well as order dated 15.11.2023 whereby appeal against order of dismissal was rejected.

The petitioner has been dismissed from service on account of FIR No. 4 dated 04.08.2017 registered against him under Sections 365, 384, 120-B IPC (419, 189 IPC added later on), 21 and 29 of NDPS Act, and 7, 13(2), 8 of PC Act. The police after completing investigation has filed its report under Section 173 Cr.P.C. The trial is pending at prosecution evidence stage.
