1. The petitioner has preferred this writ petition stating that he is the actual heir of the deceased Smt. Kashmir Kaur being her son, and the decree awarded in favour of Kashmira Singh was subject to furnishing indemnity bond.

2. Learned counsel submits that as the petitioner is the actual heir in terms of the indemnity bond, the entire amount should be paid to him.

3. It is an admitted position that the amount has already been paid to Kashmira Singh as in terms of the decree. In these circumstances, the remedy to claim the said amount lies elsewhere and not by filing a writ petition.
