(Oral) The present petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking a writ in the nature of Mandamus/Prohibition for staying the operation and implementation of order dated 26.10.2024 (Annexure P-3) and charge sheet dated 26.10.2024 (Annexure P-4) during the pendency of the statutory appeal filed by the petitioner.

At the outset, learned counsel for the petitioner submits that the petitioner would be satisfied if appropriate directions are issued to respondent No.2 (Commissioner, Hisar Division, Hisar) for deciding the stay application filed along with the statutory appeal preferred by the petitioner, in a time bound manner.

Learned State counsel on instructions from Ms. Usha Madhu, Reader, Divisional Commissioner, Hisar, submits that the stay application along with the aforesaid appeal filed by the petitioner are pending consideration before respondent No.2 (Commissioner, Hisar Division, Hisar) for 21.11.2024. It is further submitted that in all probability the stay application along with the aforesaid appeal shall be decided by the concerned Officer/Authority within a period of three weeks from the date fixed i.e. 21.11.2024 after affording due opportunity of hearing to the petitioner.

Learned counsel for the petitioner, keeping in view the aforesaid submissions made by learned State counsel, submits that he does not intend to press the instant writ petition any further, at this stage. 6.

Ordered accordingly.
