By way of present petition, prayer has been made for grant of regular bail pending trial in case FIR No.107 dated 20.03.2022 registered under Sections 148, 149, 341, 379-B, 427 and 506 IPC at P.S. Sadar Kanina, District Mahendergarh (Annexure P-1). 2.

The prayer made herein has been opposed at the instance of learned State counsel while submitting that the petitioner was involved in 14 other cases.

I have heard learned counsel for the parties and gone through the paper book. I find substance in the submissions made on behalf of the petitioner.

In pursuance to the aforementioned FIR, the petitioner was granted concession of regular bail by the Court of Addl. Sessions Judge, Narnaul vide its order dated 28.07.2022 and the petitioner continued to appear in the trial but for 20.07.2023 on account of some TEJWINDER SINGH 2023.12.19 18:23 I attest to the accuracy and integrity of this document

CRM-M-62769-2023 2023:PHHC:162944 -2bona fide confusion about the date of hearing. Having absented, the bail of the petitioner was cancelled and bail bonds/surety bonds were forfeited. Thereafter, the petitioner was arrested on 08.11.2023 and has already suffered incarceration for a period of almost one and a half month. More importantly, the petitioner has not committed any overt act between 20.07.2023 and 08.11.2023, thus, there is no reason for extending his incarceration any further.
