MANJARI NEHRU KAUL, J. (ORAL) The instant petition has been filed by the petitioner under Section 438 Cr.P.C. seeking concession of anticipatory bail in FIR No. 26 dated 23.8.2023, under Sections 21, 25, 29-61-85 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the NDPS Act') and Sections 109, 115, 120 of the Indian Penal Code, 1860, registered at Police Station State Special Operation Cell, Amritsar.

Learned State counsel at the outset has opposed the prayer made for extending the extraordinary concession of anticipatory bail to the petitioner. He on instructions from ASI BANITA CHUGH 2023.12.22 10:48 I attest to the accuracy and integrity of this document

CRM-M-62513 of 2023 -2Narinder Singh, has informed the Court that a specific secret information was received qua the involvement of the petitioner in the present case. Learned State counsel further submits that the petitioner is involved in three other cases as well.

Prima facie the petitioner appears to be a habitual offender as he is involved in as many as three cases of similar nature. Still further, the petitioner was specifically named in the secret information.

In view of the criminal antecedents of the petitioner, this Court does not deem it fit to extend the extraordinary concession of anticipatory bail to the petitioner.

The petition is dismissed as such.

However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
