***** ARCHANA PURI, J. (Oral) As observed in the previous order, despite service, the respondent did not make appearance, on that date. Even today, he has not made appearance. As such, respondent is proceeded against ex parte. Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. DMC/608/2025 titled 'Gurwinder Singh v/s Manpreet Kaur', filed by the respondent-husband, pending in the Family Court, Patiala and she seeks transfer of the same to Family Court, Derabassi, District SAS Nagar. At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 27.03.2023 and one son born from the said wedlock, who is about 14 months old, is in the care and custody of the applicant. TA-1295-2025 matrimonial dispute, is residing with her parental family and she together with the minor son, is completely dependent upon them. Even, she has filed petition under Section 12 of Protection of Women from Domestic Violence Act, which is pending in the courts at Derabassi and the respondent is making appearance in the same. The distance is stated to be 64 kms.

In view of the submissions aforesaid and more particularly, considering the applicant to be having no source of earning, while taking care of the toddler, as well as considering the fact of petition under Section 12 of Protection of Women from Domestic Violence Act, to be already pending in the courts at Derabassi, which is pursued by the respondent and above it, taking into consideration the fact of the respondent, not having come forward to resist the application, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. DMC/608/2025 titled 'Gurwinder Singh v/s Manpreet Kaur', filed by the respondent-husband, stands transferred from the Family Court, Patiala, to Family Court, Derabassi, District SAS Nagar.

The requisite record of the aforesaid case be sent by the Family Court, Patiala to the District and Sessions Judge, SAS Nagar.

Learned District and Sessions Judge, SAS Nagar, shall assign the said petition to the Family Court, Derabassi. Even, the parties are directed to appear before the Family Court, Derabassi, within a period of one month from today onwards.
