***** ARCHANA PURI, J. (Oral) Respondent has made appearance before the court and to affix his identity, he has supplied the copy of his Aadhar Card, which is taken on record and submits that he has no objection if the transfer application is accepted and the case stands transferred.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/98/2021 titled 'Himanshu Marwaha v/s Anjali Marwaha', filed by the respondent-husband, pending in the Family Court (Camp Court), Sultanpur Lodhi, District Kapurthala and she seeks transfer of the same to the Court of competent jurisdiction at Ludhiana.

It is submitted by the counsel for the applicant that the son born from the wedlock of the parties, is in the care and custody of the applicant. Also, it is submitted that the applicant has filed one petition under Section 125 Cr.P.C., which is pending in the courts at Ludhiana and the civil suit for permanent injunction earlier filed, has since been decided ex parte. Considering the factual position aforesaid and the statement made by the respondent, the transfer application is hereby allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/98/2021 titled 'Himanshu Marwaha v/s Anjali Marwaha', filed by the respondenthusband, stands transferred from the Family Court, Family Court (Camp Court), Sultanpur Lodhi, District Kapurthala to the Court of competent jurisdiction at Ludhiana. The requisite record of the aforesaid case be sent by the Family Court (Camp Court) Sulanpur Lodhi, to the District and Sessions Judge, Ludhiana.

Learned District and Sessions Judge, Ludhiana, shall assign the said petition to the Family Court, Ludhiana. Even, the parties are directed to appear before the Family Court, Ludhiana, within a period of one month from today onwards.
