CORAM:
HON'BLE MR. JUSTICE SANJAY VASHISTH.
Present:
Mr. Neeraj Jain, Advocate, for the petitioner. SANJAY VASHISTH , J (ORAL) CRM-33205-2025 1.
Present application has been moved by the applicant/petitioner for placing on record evidence as Annexure P-4. 2.
Considering the averments mentioned in the application, prayer made in the application is allowed and evidence is ordered to be taken on record as Annexure P-4. Registry is directed to tag the same at the appropriate place on the file.
3.
CM stands disposed of.
CRM-M-57820-2024 1.
Present petition has been filed by the petitioner, seeking grant of regular bail, in case, FIR No.19, dated 26.03.2023, under Sections 302, 120-B of IPC, registered at Police Station Jhunir, District Mansa.
2.
Counsel for the petitioner submits that complainant, Ramandeep Singh, has lodged the present FIR against his own father, alleging that his father had developed illicit relations with Jaswinder
-2Kaur @ Golo, who is also related to the complainant as his aunt. On the evening of 25.03.2023, Jaswinder Kaur @ Golo visited the family house in village Fatehpur, which led to a heated dispute within the household. Thereafter, the complainant's father and Jaswinder Kaur @ Golo left the house, and the matter was discussed with the complainant's maternal uncle, Jaswant Singh, who had also arrived that evening. Later, complainant's father returned home. Around 11:00 p.m., complainant allegedly saw his father sitting on the bed and strangulating his mother, Paramdeep Kaur. On hearing the commotion, Jaswant Singh rushed to the spot, and the next morning, incident was conveyed to other relatives. 3.
Learned counsel for the petitioner vehemently contends that petitioner has been falsely implicated in the present case. He further submits that testimony of the complainant and other material witnesses has already been recorded.
It is also pointed out that co-accused Jaswinder Kaur @ Golo, who may have been cause of the dispute but was not present at the time of the occurrence, has already been granted the concession of regular bail, vide order dated 18.09.2024 passed in CRM-M-17875-2024 (Annexure P-3). Thus, counsel prays that petitioner be released on regular bail in the present case.
4.
Notice of motion.
5.
On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab, puts an appearance on behalf of the respondent/State, and submits that, as per the medical opinion, cause of death in the present case has been
-3declared to be asphyxia due to strangulation, thereby corroborating the factual allegations made in the FIR.
It is further contended by learned State counsel that complainant, Ramandeep Singh, who is the son of the petitioner, has already been examined and has fully supported the prosecution version. 6.
This Court has heard the submissions advanced by learned counsel for both parties and has carefully perused the record available on file.
7.
FIR in the present case has been lodged by none other than petitioner's own son, and motive for the occurrence has also been clearly established. In view of the nature and gravity of the allegations, this Court finds no justifiable reason to entertain the present petition or to extend the concession of bail to the petitioner, who is alleged to have murdered his own wife on account of an extramarital relationship. Accordingly, present petition stands disposed of. However, learned trial Court is directed to expedite the trial proceedings and conclude the same at the earliest, in accordance with law.
8.
A copy of this order be forwarded to learned trial Court for information and necessary compliance.
