Petitioner is seeking the concession of anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 in case FIR No.21 dated 16.02.2023 registered under Sections 419 and 420 of the IPC and Section 66-D of the I.T. Act registered at Police Station Cyber West, District Gurugram.

Learned counsel for the petitioner, inter alia, contends that the petitioner has been falsely implicated in the instant case; Neither was the petitioner named in the FIR in question nor was there any direct transaction between him and the complainant; no recovery also was effected from the petitioner and hence, it was evident that the petitioner was not, in many manner, linked to the crime in question.

I have heard learned counsel for the petitioner and perused the relevant material on record including the allegations levelled in the FIR.

Prima facie, it comes across that the petitioner along with his co-accused has committed an online fraud upon the complainant. As per allegations levelled, the account in which the money was PUNEET SACHDEVA 2023.12.15 17:21 I attest to the accuracy and integrity of this document.

CRM-M-62817-2023 -2transferred by the complainant was being operated by none other than the complainant himself. It also comes across that the complainant had transferred various amounts of money totalling approximately Rs.39 lakh into the account of the petitioner. In the circumstances, keeping in view the nature of allegations levelled against the petitioner, this Court does not deem it fit to extend the extraordinary concession of anticipatory bail to him.

The instant petition stands dismissed.

However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
