The present petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.342 dated 29.11.2022, registered under sections 22 and 29 of NDPS Act, 1985, at Police Station Civil Lines, Batala, District Gurdaspur.

As per custody certificate filed by learned State counsel, the petitioner is behind bars for only 1 year and 18 days, commercial quantity of contraband has been recovered from him and out of 11 prosecution witnesses, 5 have been examined.

Learned counsel for the petitioner though has raised the arguments that the mandatory provisions of Sections 42 and 50 of NDPS Act were not complied with, however, in view of the aforesaid fact, particularly regarding the stage of the case as well, she prays for withdrawal of the instant petition at this stage and issuance of a direction to the trial Court to expedite the trial within a time bound manner.

Dismissed as withdrawn at this stage.
