Counsel for the petitioner submits that the complaint is defective and affidavit is filed by another person and similarly signed by someone else and this fact has been proved in examination-in-chief of witness. 3.
On the query of this Court, the counsel could not explain the reasons that why he did not challenge the order dated 29.11.2022 well in time and why after a gap of around two years, he approached this Court.

Faced with this situation, petitioner's counsel wants to withdraw the present petition with following liberty:-
1. The petitioner be granted permanent exemption;
2. He be permitted to raise all the points at the appropriate stage of trial and;
3. He should also be permitted to take up the defence under Section 315 Cr.P.C.

Given above, the present petition is disposed of as withdrawn. 6.
Liberty reserved to the petitioner to raise all points at appropriate stage before trial Court and also appear as witness under Section 315 Cr.P.C.
