*** PANKAJ JAIN, J. (ORAL) RSA-2796-2024 Present appeal has been filed against judgment dated 16.03.2023 passed by Additional Civil Judge (Sr. Division), Bholath and against judgment dated 25.10.2024 passed by Addl. District Judge, Kapurthala dismissing appeal filed by the appellant-defendant.

Learned counsel for the appellant/petitioner has pointed out to the testimony of Kuldeep Singh, who appeared as PW1, the attesting witness to the agreement to sell and submits that he admitted that the agreement in question was scribed on the blank papers having signatures of Satnam Singh-defendant.

Mr. Atul Jain, Advocate for the respondent submits that it is a suggestion which was put to Kuldeep Singh and Kuldeep Singh denied the said suggestion. The same is evident from the testimony of Kuldeep Singh, which reads as under :- "The agreement to sell was scribed on the stamp paper of Rs.50/-. The stamp paper of Rs.50/- was purchased from the Ashok Kumar. My village is at the distance of one and half kilometer from Bholath. None out of the purchaser or the alleged seller belongs to my village. I have not come today to help my maternal uncle. Mehnga Singh is my maternal uncle(mama). The other witness of the agreement is Kulbir Singh. Kulbir Singh is my near brother and Mehanga Singh his maternal uncle(mama). The source of income of Mehanga Singh is pension, and he is a retired army man. I singed the register of the deed writer.

But it might be possible that he have might signed the register of deed writer volunteer I had come and thereafter my brother had gone. Satnam Singh is the brother of the son in law Mehanga Singh. I do not know if Satnam Singh had obtained a loan of Rs.1 lacs from his brother which was paid by Mehanga Singh on the asking of his son in law. I do not know if at the time of advancing of Rs.1 lac, Mehanga Singh got the signature of Satnam Singh on blank Stamp paper.

Apart from that defendant-Satnam Singh admitted that he went to Tehsil and signed the register of the scribe. No other issue has been raised.

In view thereof, there is no reason to interfere in the concurrent finding of the fact recorded by the Courts below. Resultantly, the appeal is dismissed.

CR-1284-2025 Learned counsel for the petitioner states that he does not want to press this petition.

Allowed as prayed for.
