(ORAL) Apprehending his arrest in FIR No.377 dated 09.09.2023, registered for offences punishable under Sections 406, 420 of the Indian Penal Code, 1860 at Police Station Tehsil Camp, District Panipat, the petitioner has preferred this petition under Section 438 Cr.P.C. seeking prearrest bail. 2.

On query of the Court, Mr. Gaurav Bansal, DAG, Haryana who appears on advance notice submits that no notice under Section 41-A Cr.P.C. has been served upon the petitioner as yet. He further submits that the investigating agency before making arrest shall comply with the same in view of dictum of law laid down in Arnesh Kumar vs. State of Bihar and another, (2014) 8 SCC 273.
