(ORAL) Present writ petition has been filed for quashing the order dated 22.03.2023 (Annexure P-3) passed by respondent No.3 and order dated 14.06.2023 (Annexure P-4) passed by respondent No.2 respectively and further for directing the respondents to reinstate the petitioner as sarpanch, with all consequential benefits, keeping in view the facts and circumstances of the case and proceedings against the petitioner may be stayed.

Notice of motion to the official respondents at this stage. On asking of the Court, Mr. Navneet Singh, Sr. DAG, Punjab appears and accepts notice on behalf of the official respondentsState. He has submitted that the petitioner failed to appear before the Enquiry officer despite the fact that he was summoned time and again. CWP No.4787 of 2024 -2- 2024:PHHC:028986 has already been initiated and the same is pending consideration with ADC(D), Hoshiarpur. He prays for impleading ADC(D), Hoshiarpur as a party in the present petition.

Learned counsel for the petitioner has submitted that the petitioner could not appear before the Director, Rural Development & Panchayat Department, Punjab as he was lying admitted in the Hospital due to brain hemorrhage. He also prays for impleading ADC(D), Hoshiarpur as a party in the present petition.

In view of the above submission made by learned counsel for the State, present petition is disposed of with a direction to newly added respondent No.7 i.e. ADC(D), Hoshiarpur to conclude the regular inquiry against the petitioner pending with it within a period of two months from the date of receipt of copy of this order after affording an opportunity of being heard to the petitioner as per law.
