Arshad v. State Of Haryana

Apprehending his arrest in FIR No.238 dated 18.05.2023, registered for offences punishable under Sections 21-C and 29 of the NDPS Act, at Police Station Sadar Yamuna Nagar, District Yamuna Nagar, the petitioner has preferred this petition under Section 438 Cr.P.C. seeking pre-arrest bail.

Ld. Counsel for the petitioner inter alia submits that the petitioner has been nominated on the disclosure made by one Manavar who himself was nominated on the disclosure made by Nadir from whom 361 grams of heroin was recovered. He further submits that both Manavar and Nadir already stand admitted to default bail.

Issue notice of motion, returnable for 03.04.2024. Mr. Gaurav Bansal, DAG, Haryana appears and accepts notice on behalf of the respondent/State.

In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal and surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. As and when called, the petitioner shall join the investigation. He shall abide by the conditions enumerated under Section 438(2) of the Cr.P.C.
