The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to release the payment.

Reply by way of affidavit of Dilpreet Singh, Executive Engineer, Jandiala Division UBDC, Amritsar, Water Resource Department Punjab filed on behalf of respondents is taken on record. Registry is directed to tag the same at an appropriate place. 3.

Learned counsel for the petitioner submits that petitioner was awarded two contracts. It is a proprietorship concern having small investment. It completed both the contracts, however, respondent has not released payment. It cannot apply for any other contract because its entire investment is blocked.

Learned State counsel submits that petitioner did not complete the work. The work was further found defective. It was subjected to penalty on account of non-completion of work. There is complete mechanism for redressal of dispute between the parties. The petitioner is supposed to follow said procedure. 5.

From the perusal of record and arguments of both sides, it is evident that claim made by petitioner is disputed by respondents. This Court cannot issue direction to respondents to make payment of disputed liability while exercising writ jurisdiction. 6.

The petition stands disposed of with liberty to petitioner to avail remedies as permissible by law.
