1. The petitioner has seeks quashing of FIR No. 127, dated 06.09.2023, Police Station Chattiwind, District Amritsar (Amritsar Rural), under Sections 294, 504, 506 IPC and Section 67 of the I.T. Act, wherein the allegations levelled are to the effect that the petitioner had hacked the mobile phone of complainant's daughter and had posted photographs of her daughter on social media by making a fake I.D. from her daughter's phone.

2. Learned counsel for the petitioner submits that it is a case of bald allegations only and that despite the matter having been investigated, no evidence could be collected by the police so as to connect the petitioner with the alleged offence and as a matter of fact even the District Attorney had made similar observations, but despite the same the police has presented challan. CRM-M-58608-2024 (O&M) ( 2 ) disputed that as of now the trial Court has not considered the questions as regards framing of charges.

3. In view of the aforestated position wherein the matter is fixed before the trial Court to consider the framing of charges, this Court deems it appropriate that the instant petition be disposed off at this stage with liberty to the petitioner to raise all the pleas as have been raised herein before the trial Court at appropriate state including his plea as noted above and also his plea that the FIR came to be registered belatedly i.e. after about 2 years.

4.
