Present writ petition has been filed under Article 226 of the Constitution, inter alia, for directing the respondents to provide fair and proper opportunity of hearing to the petitioner while granting legal assistance in the disciplinary proceedings initiated against him in pursuance of the charge-sheet dated 17.07.2023 (P-12). 2.

Although, there is no formal notice of motion in this case, but learned State counsel has produced a communication dated 27.11.2024 issued by the Superintendent/NGE-3, for Chief Engineer/Head Quarter, Water Resources Department, Punjab and which is taken on record as Mark 'X'. For reference, para No.4 of the same reads as under:- "4.0 That it is respectfully submitted that after considering the prayer of the petitioner & in compliance of the order dated ATUL SETHI 2024.11.27 17:12 I attest to the accuracy and integrity of this document

CWP-31588-2024 25.11.2024 passed by this Hon'ble Court, the Department is ready to provide a retired Superintendent of Water Resources Department, Punjab to present the case of petitioner during personal hearing before the competent authority."

In view of the specific recital made in para No.4 (ibid), learned counsel for the petitioner, on instructions, submits that present petition be disposed off as not pressed "at this stage". 4.

Ordered accordingly.
