Learned counsel for the petitioners submits that the petitioners had purchased the membership (shares from respondents No.5 to 7 in 'The Shivalik Environ Cooperative House Building Society Ltd., Saketri) in the years 2022 (petitioners No.1 and 2) and 2020 (petitioner No.3), respectively, and that requisite sale-deeds/agreements, affidavits, indemnity bonds etc. were executed in the years 2022 and 2020, respectively, and a request was also made to respondent No.4 - The Shivalik Environ Cooperative House Building Society Ltd. for effecting the requisite changes in the record pertaining to the transfer of the said shares, but till date nothing has been done.

Learned counsel for the petitioner submits that the petitioner submitted representations dated 3.12.2022 (Annexure P-18), 3.12.2022 (Annexure Pankaj Kakkar 2023.12.18 17:06 I attest to the accuracy and authenticity of this document

CWP-28414-2023 (O&M) ( 2 ) 2023:PHHC:162111 P-19) and 29.10.2020 (Annexure P-20) in this regard, but nothing has been done till date. Learned counsel for the petitioners further submits that the sellers/respondent Nos.5 to 7 also submitted applications dated 3.12.2022 (Annexure P-9), 3.12.2022 (Annexure P-10) and 29.10.2020 (Annexure P-11) alongwith affidavit and indemnity bonds to the said society at its registered address, but nothing effective has been done till date. Learned counsel for the petitioners submits that at this stage, the petitioners would be satisfied in case a direction is issued to respondents No.2 to 4 to consider their request for transfer and to pass appropriate order expeditiously. 3.

In view of the limited prayer made by the learned counsel, the instant petition is disposed of with a direction to respondents No.2 to 4 to consider the case of the petitioners for transfer of the share/membership in the society which they claim to have purchased from respondents No.5 to 7 in the years 2022 and 2020, respectively. The petitioners would be at liberty to file a detailed representation along with any document, as may be required in this regard, to the respondents. The respondents No.2 to 4 are directed to take a final decision expeditiously in the matter.
