It is, inter alia, contended by learned counsel for the petitioner that the petitioner has not committed any offence infact he and the complainant had been jointly undertaking the property business and the petitioner had purchased the property vide sale deed dated 27.05.2011 (Annexure P-2) for an amount of Rs. 1.50 lacs and has sold the same vide sale deed dated 14.07.2014 for an amount of Rs. 2.99 lacs (Annexure P-4).

. Learned counsel for the petitioner further contends that in fact some documents of the petitioner were lost regarding which he had informed the police vide DDR No. 39 dated 07.07.2014 (Annexure P-5) and one such document had been misused by the complainant to create sale agreement dated 31.05.2011 (Annexure P-3). He contends that the petitioner specifically denies having executed Annexure P-3 dated 31.05.2011 but even otherwise the complainant never availed the remedy available under the law and all of sudden after 08 years got registered the instant FIR just to harass the petitioner.

4. Notice of motion.

5. On the asking of the Court, Mr. Anmol Singh Sandhu, AAG, Punjab, present in Court, accepts notice on behalf of the Staterespondent and prays for time to file the status report/reply in the matter.

6. Adjourned to 10.01.2024.

7. Needful be done well before the date fixed with an advance copy to the counsel opposite.

8. In the meanwhile, the petitioner is hereby directed to join investigation within seven days from today and in the event of his arrest, he is ordered to be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 438(2) Cr.P.C."
