0 Keeping in view the facts and circumstances of the case and the fact that the petitioners are in custody since 16.07.2024 i.e. for more than 01 year and 04 months; charges have been framed and out of total 10 prosecution witnesses, none has been examined so far; co-accused namely/#

98) who are on the same footing as that of the petitioners, have already been granted the concession of bail; there is no material on the file to show that in case the petitioners are released on bail, they may tamper with the prosecution evidence; moreover, bail cannot be denied just as a measure of punishment as culpability of the accused will be decided at the final stage by the Trial Court after adducing of evidence by both sides<trial will take time to conclude; no useful purpose would be served by keeping them in custody for any further period; this Court deems it a fit case to grant the concession of regular bail to the petitioners. 7.

Therefore, without expressing any opinion on the merits of the case, the instant petitions are allowed. The petitioners are ordered to be released on regular bail on their furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned.

Nothing observed herein shall be construed as an opinion on the merits of the main case.
