The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondents to re-issue his passport.

The petitioner was issued passport on 03.02.2012 which expired on 02.02.2022. The petitioner came to be implicated in FIR No. 4 dated 03.02.2014, under Sections 7, 13(2) of Prevention of Corruption Act, 1988 read with Section 120-B of IPC. The petitioner has preferred CWP No. 17154 of 2016 before this Court assailing order dated 03.07.2015 whereby sanction to prosecute the petitioner was granted by Director, Urban Local Bodies, Punjab. This Court vide order dated 24.08.2016 has stayed operation of the order dated 03.07.2015. The petitioner filed application before trial court seeking direction to respondents to re-issue his passport. CWP No. 28338 of 2023 -2- 2023:PHHC:161635 The trial court vide order dated 10.03.2023, permitted the petitioner to apply for re-issuance of passport and passport authority was directed to decide application of the petitioner in accordance with law. The petitioner has preferred an application seeking re-issuance of passport and the said application is still pending before the passport authority. 3.
In view of order dated 10.03.2023 passed by trial court, no order is warranted by this Court. Passport authority is duty bound to comply with order dated 10.03.2023 passed by trial court. 4.
