Seeking issuance of writ in the nature of mandamus directing the respondent No.3 to submit premature release case of the petitioner who is eligible for consideration for premature release along with comments and record of remission duly signed and authenticated to respondent No.2 as per clause No.7 of Premature Release Policy dated 13.08.2008 (P-2), the petitioner has come up before this Court under Article 226/227 of Constitution of India.

Notices served upon the official respondents through the State's counsel. Given the nature of the order that this Court proposes to pass, neither the response of official respondents nor the issuance of notices to the private respondents is required. 3.

Counsel for the petitioner submits that one of co-convict in the same FIR has been released by the Jail Authorities after considering his case for pre-mature release and petitioner's jail term and other antecedents are at par with said co-convict namely Bansi.

Given above, the petition is disposed of. Let a decision be taken by the concerned authorities that whether the petitioner is entitled to same relief as was given to some co-convict and because of Article 14 which provides equality before law and grounds on parity.
