DEEPAK GUPTA , J.(Oral) By way of present petition filed under Section 439 Cr.P.C., petitioner has prayed for grant of regular bail in case FIR No.108 dated 08.07.2023 registered under Section 22(c) and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station City Sri Muktsar Sahib, District Sri Muktsar Sahib.

As per the allegations, 1000 tablets of Colovidol-100 SR containing salt of Tramadol Hydrochloride were recovered from the conscious possession of co-accused Satpal Singh on 08.07.2023, who in his disclosure statement, nominated one Sonu Kumar and petitioner to be the supplier.

It is contended by learned counsel that petitioner has been falsely implicated; that co-accused Sonu Kumar, who is similarly placed as that of the petitioner, has already been allowed by this Court vide order dated 11.12.2023 passed in CRM-M-54373-2023; that no recovery has been effected from the petitioner nor he has any criminal antecedent. 4.

Learned State Counsel concedes the fact that no recovery has been effected from the petitioner.

As per the custody certificate placed on record by learned State counsel, petitioner is in custody for the last 05 months and 11 days, with no criminal antecedent, besides co-accused Sonu Kumar has already been allowed bail vide order dated 11.12.2023 (Annexure P-3). 8.

Having regard to the aforesaid facts and circumstances, particularly on the basis of parity, but without commenting anything on the merits of the case, petitioner is admitted to bail. He is ordered to be released on bail on his furnishing requisite bail bonds and surety bonds to the satisfaction of learned trial Court/ Duty Magistrate concerned on usual terms and conditions.

Allowed.
