The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him passport.

The petitioner vide application dated 16.11.2023 has applied for passport. An FIR No.5,dated 30.01.2012, under Sections 307, 323, 34 of IPC was registered against the petitioner at Police Station, Kheri Gandian, District Patiala. The petitioner was convicted vide judgment dated 7.10.2013 passed by Additional Sessions Judge, Patiala and awarded sentence of five years vide order dated 8.10.2013. The petitioner preferred CRA-S-3689-SB of 2013 before this Court. Sentence of the petitioner was suspended vide order dated 30.10.2013 passed by this Court. Learned counsel for the petitioner states that case of the petitioner is covered by judgment of this court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391 4.

Learned State counsel, who on advance notice is present in Court, states that police has already sent police verification report to passport authority.

Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioner may be directed to appear before passport authority alongwith requisite documents and thereafter, the passport authority would pass an appropriate order within six weeks in the light of aforesaid judgment.

In the wake of statement of learned counsel for Union of India, the petition stands disposed of with a direction to petitioner to appear before passport authority on 05.01.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 05.01.2024.
