Learned counsel submits that the petitioner was recommended for promotion on 27.04.2022 to the post of Assistant, however no order was passed thereon and he was retired on attaining the age of superannuation on 31.08.2022, whereafter his junior was promoted. The claim of the petitioner is for grant of notional promotion to him, in wake of the aforesaid facts, with regard to which a representation dated 28.10.2024, Annexure P-8, has been submitted, however the same has yet not evoked any response. He thus, at this stage, on instructions, from the petitioner, prays that a direction is given to respondent Nos.1 and 2 to decide the same in a time bound manner. 2.

At the asking of the Court, Ms. Vibha Tewari, AAG, Haryana accepts notice on behalf of the respondent-State and has no objection to the limited prayer made.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent Nos.1 and 2 to consider and decide the representation 28.10.2024, Annexure P-8, within a period of 4 months, which this Court has no reason to believe the HAMANT 2024.11.25 16:10 I attest to the accuracy and integrity of this document
CWP-31615-2024 authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
