The petitioner belongs to General Category. He pursuant to Advertisement No. 7/2024 dated 15.07.2024 applied for different posts. It is apt to notice that respondent by common advertisement invited applications for different posts. The candidates were free to apply for as many categories as they wanted. In Category Nos. 71 and 72, there is no post reserved for EWS. The petitioner being member of General category is eligible for Category Nos. 71 and 72. In his application form, he has applied for Category Nos. 71 and 72 apart from other categories. The respondent is not ready to treat him under General Category for posts under Category Nos. 71 and 72.

Ms. Shruti Jain Goel, Sr. DAG, Haryana expressed her inability to controvert the fact that petitioner in his application form has applied for different categories including Category Nos. 71 and 72 and there is no post reserved for EWS and he has right to apply under Category Nos. 71 and 72 apart from other categories,.

It is a case of common advertisement for different posts. Had there been different advertisements for different posts, the petitioner could have apply under General Category in respect of posts where seats are not reserved for EWS. He cannot be disentitled to be considered for a particular post under General Category if there is no post for EWS Category. Accordingly, the respondents are directed to consider the petitioner for Category Nos. 71 and 72 as General Category candidate. 5.
