Petitioner - Basheer Muhammad, aged about 57 years, has filed instant petition u/s 528 of BNSS, 2023, for transfer of investigation to the CBI in case i.e. FIR No.109, dated 21.11.2023, under Sections 323, 325, 506, 148, 149, 201 of IPC (Sections 325, 307 of IPC added later on), registered at Police Station Khamanon, District Fatehgarh Sahib. 2.

Counsel for the petitioner contends that while the police investigation has been concluded, the challan has been submitted in a manner favoring the accused. Despite four grievous injuries to four different injured persons, including two head injuries, Section 307 of the IPC, which was initially invoked, has been omitted at the time of filing the challan. However, he submits that since the final report u/s 173 Cr.P.C., has already been submitted by deleting Section 307 of IPC, he be allowed to withdraw present petition, same being not pressed, by granting liberty to take required plea before the appropriate forum at appropriate stage, in JAWALA RAM 2025.02.20 19:30 I attest to the accuracy and authenticity of this document
