*** DEEPAK GUPTA, J. (ORAL) [1] On 16.12.2023, the following order was passed by this Court:- " Present:
Mr. Hitesh Chopra, Advocate for the petitioner. Mr. Hakam Singh, AAG, Punjab.
(Through Hybrid mode).
**** This is a petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.108 dated 08.09.2023 under Sections 304 and 120-B of IPC, registered at Police Station Sujanpur, District Pathankot.
Learned counsel for the petitioner, inter alia, argued that the petitioner is innocent and has been falsely implicated in the present case. It is submitted that initially the FIR was registered against coaccused Devinder Singh @ Bikka and some of his other accomplices who were not named. The complainant suffered a supplementary statement after two days, whereby the petitioner along with few others was nominated as an accused. There is delay in lodging the FIR as well as delay in recording the supplementary statement, which has not been explained. Co-accused Suraj and Monty, who are similarly placed to the petitioner, have already been granted the concession of interim/anticipatory bail by this Court. It is the admitted case of the complainant that his son was a drug addict. It has been averred in para 14 of the petition that the petitioner is not involved in any other case. He has clean antecedents as such. The petitioner is ready to join investigation and cooperate with the investigating agency.

In the meanwhile, petitioner shall join the investigation and would associate as and when called. In the event of arrest, the petitioner shall be admitted to interim bail on his furnishing personal bond and surety to the satisfaction of Arresting Officer/Investigating Officer. The petitioner shall abide by the conditions specified in Section 438(2) Cr.P.C."
[2] Today, learned State Counsel, on instructions from ASI Sushil Kumar, has informed this Court that the petitioner has joined the investigation, in compliance of the order dated 16.12.2023 and is no longer required for further investigation.
[3] In view of the aforesaid, the order dated 16.12.2023, whereby the petitioner was granted interim anticipatory bail, is hereby made absolute. However, he shall continue to join investigation, if and so required by the Investigating Officer.
[4] Disposed of.
