The present petition has been filed under Section 482 BNSS, 2023, for grant of anticipatory bail to the petitioner in case FIR No.01, dated 02.01.2025, under Sections 22 and 29 of NDPS Act, registered at Police Station Mehna, District Moga.

On 14.11.2025, the C-ordinate Bench had passed the following order:- "Petitioner, an accused, in case FIR No.01 dated 02.01.2025 registered against her for commission of offence punishable under Sections 22/29 of the NDPS Act, 1985, at Police Station Mehna, District Moga, has filed the present petition for grant of pre-arrest bail.

Learned counsel for the petitioner submits that petitioner was nominated in the present case on the basis of the disclosure statement of coaccused Tirath Singh, who was allegedly caught red handed while keeping in his illegal possession 5.85 grams Etizolam. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. Apart from the disclosure statement of co-accused Tirath Singh, there is nothing else to connect her with the commission of the offence. The said disclosure statement is a weak kind of evidence. It is the further submission of learned counsel that during the course of investigation, Investigating Officer could not lay his hands on any call details of the petitioner or her bank transaction with the other accused. Learned counsel further submits that petitioner is willing to join the investigation as and when called for by the IO. Notice of motion.

Mr. Gautam Thapar, Sr. DAG, Punjab appears and accepts notice on behalf of the State. He requests for a short adjournment to file a detailed status report.

In view of the submission advanced by learned counsel for the petitioner, but without expressing any opinion on the merits of the case, the petitioner is hereby directed to join investigation within seven days from today and co-operate in the same. In the event of the arrest of the petitioner, she shall be released on interim bail on her furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. She shall also abide by conditions as envisaged under Section 482(2) BNSS. Adjourned to 08.12.2025.

Status report be filed on or before the next date of hearing with an advance copy to the opposite counsel.

Learned counsel submits that in pursuance of the afore-mentioned order, the petitioner has not only joined investigation but also fully cooperated with the investigating agency. He further submits that in case the investigating agency requires the petitioner to appear, she shall make herself available without demur.

Learned State counsel on instructions from the Investigating Officer affirms the factum of joining the investigation by the petitioner and cooperating with the investigating agency. She also submits that at this stage, the petitioner is not required for further custodial interrogation. 5.

In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petition filed by the petitioner is allowed and the order dated 14.11.2025 granting interim bail to her, is hereby made absolute, subject to compliance of conditions as specified under Section 482(2) of BNSS, 2023.

However, it is made clear that if the petitioner fails to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to her.
