The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him passport.

The petitioner vide application dated 20.04.2023 has applied for passport. An FIR No. 562 dated 25.09.2005, under Section 292 of IPC came to be registered against the petitioner at Police Station City Yamuna Nagar. The petitioner, vide order dated 08.10.2005 passed by Chief Judicial Magistrate, Jagadhri, was convicted and sentenced to undergo imprisonment till rising of the Court and to pay a fine of Rs. 1000/-. The petitioner deposited the fine. The petitioner is not involved in any other offence still passport authority is not issuing him passport. Learned counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. 4.

Ms. Amrita Singh, counsel for Union of India submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within six weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statements of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 29.01.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 29.01.2024.
