1. The petitioner seeks issuance of directions to the official respondents to protect her life and liberty and also of other members of her family as she apprehends threat to the same at the hands of respondents No.4 and 5 namely Naveen Kumar and Parveen Kumar. Another prayer has been made for issuance of a writ in the nature of Mandamus directing the official respondents to take appropriate action against respondents No.4 and 5.

2. Learned counsel submitted that although representation dated 30.8.2024 (Annexure P-7) had been made to SHO concerned, but no action has been taken thereupon.

3. Notice of motion.

4. At this stage, Mr. Siddharth Attri, AAG, Punjab has put in appearance on behalf of respondent-State and Ms. Shivya Sehgal, Advocate, has put in appearance on behalf of respondent No.4 and has filed power of attorney. The same is taken on record.

Learned counsel representing respondent No.4 submitted that as a matter of fact the petitioner has already approached the learned Judicial Magistrate 1st Class concerned and moved application under Section 175(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 for seeking requisite relief for registration of case. Learned counsel has today passed on some copies of zimni orders recorded by learned Judicial Magistrate 1st Class, which are taken on record.

In view of the aforestated position wherein the petitioner is already availing the appropriate remedy by way of filing an application under Section 175(3) of Bharatiya Nagarik Suraksha Sanhita, 2023, this Court does not find any ground for issuance of directions as prayed for pertaining to the grievances recorded in representation dated 30.8.2024 (Annexure P-7).

As far as the prayer of the petitioner seeking protection of his life and liberty as well as of other members of family is concerned, the petitioner would be well advised to move a detailed representation in this regard to Senior Superintendent of Police concerned. Upon any such representation is being filed, the Senior Superintendent of Police concerned shall get the same examined and take necessary steps as may be warranted under facts and circumstances of the case.
