Prayer in this writ petition filed by the petitioner under Article 226 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to pay the arrears of pay and pension after revision of pay as per the Punjab Civil Services (Revised Pay) Rules, 2021, which came into force w.e.f. 01.01.2016 as amended till date and to further grant difference of gratuity and leave encashment after revision of pay. Further prayer has been made to direct the respondents to grant all the arrears of pay and pension with interest @ 18% per annum.

Learned counsel for the petitioner submits that for claiming the aforesaid relief, the petitioner has submitted a legal notice dated 18.09.2024 (Annexure P-5) and at this stage, the petitioner would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

Mr. Surya Kumar, AAG, Punjab, accepts notice on behalf of respondents No.1 to 3 and Mr. Vipul Jindal, Advocate, accepts notice on behalf of respondent No.4 and have no objection to the innocuous prayer made by learned counsel for the petitioner. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.4 to consider and decide the legal notice dated 18.09.2024 (Annexure P-5), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of three months from the date of receipt of certified copy of this order.
