The present petitioner had earlier approached this Court by filing CRM-M-36223-2023 wherein the following order was passed on 02.11.2023 :

"1.

Learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to avail his remedies as available under the law. Permitted to do so. 2.

Dismissed as withdrawn with the liberty aforesaid. Pending applications, if any, also stand disposed off." PARKASH CHAND 2024.01.16 14:46 I attest to the accuracy and authenticity of this order/judgment

Strangely, the category of the case was changed when the present petition was filed and the matter was listed before a Co-ordinate Bench on 19.12.2023 and the following order was passed : "This Court fails to comprehend as to why the present petition has been listed before this Court, when the earlier petition for the same relief was dismissed as withdrawn on 02.11.2023 before a coordinate Bench. Let the present petition be listed before the same Bench after soliciting orders from Hon'ble the Acting Chief Justice."

The matter has thereafter been put up before this Court as the order dated 02.11.2023 was already passed by this Court. Today, the learned counsel for the petitioner seeks permission to withdraw the present petition. Permitted to do so.

Dismissed as withdrawn. Pending applications, if any, also stand disposed off.

As per office note, the OSD (Listing) has already directed Mr. Amit Batra and Ms. Sakshi Sharma, Senior Assistants to remain more vigilant in future. Both the Senior Assistants are warned to be careful in future.
