On 09.01.2024, this Court had passed the hereinafter extracted order:- "1. The instant revision petition is directed against the verdict of conviction and order of sentence dated 25.05.2018, whereby, the learned Magistrate concerned has convicted the petitioner under Section 138 of the Negotiable Instruments Act, 1881, and, has sentenced him to undergo R.I. for two years. In addition, the petitioner has also been directed to pay compensation, under Section 357 Cr.P.C., to the respondent/complainant to the tune of double cheque amount.

2. The instant revision petition also assails the judgment dated 19.09.2023, whereby, the learned Additional Sessions Judge concerned dismissed the statutory appeal preferred by the petitioner against the verdict of conviction and order of sentence (supra).

3. The learned counsel for the petitioner seeks some time to inform this Court as to whether the petitioner is ready and willing to surrender before the learned trial Court concerned to honour the sentence imposed upon him, or, not.

It appears that the petitioner is not interested to pursue the instant petition, therefore, since it is already 03:30 p.m. and no further wait is justified, consequently, the instant petition is dismissed for non prosecution.
