In the present writ petition, the grievance of the petitioner is that in the ACR of the petitioner for the year 2013-2014, adverse remarks were recorded due to which, the petitioner was not given the benefit of first ACP for which the petitioner became entitled for in the year 2016 but now, in the year 2023, vide order dated 15.06.2023 (Annexure P-9), the said adverse remarks have been expunged and the ACR of the petitioner has been treated as good hence, the respondents are under an obligation to grant the benefit of ACP on completion of 8 years service which the petitioner would have got in the year 2016.

Learned counsel for the respondents submits that in case the petitioner is aggrieved in any manner and he files any representation on the basis of the order dated 15.06.2023 (Annexure P-9), appropriate consideration will be given to the claim of the petitioner for the grant of ACP from the due date and speaking order will be passed within a period of eight weeks of the receipt of any such representation. 5.

Learned counsel for the petitioner submits that keeping in view the statement of learned counsel for the respondents, the present writ petition may kindly be disposed of having been not pressed any further with liberty to the petitioner to file appropriate representation on the basis of the order dated 15.06.2023 (Annexure P-9) so as to claim the benefit of ACP from due date.
