Prayer made in the present petition is for setting aside the order dated 03.11.2023 passed by learned Additional Chief Judicial Magistrate, Barnala in complaint No.NACT-29-2019 dated 16.10.2019 vide which the application under Section 311 Cr.P.C. filed by the petitioner was dismissed. 2.

Learned counsel submits that the petitioner prays to complete the cross-examination of complainant, which has been declined only on account of the fact that there being request made on 26.10.2023, wherein the case is stated to be taken up on 11:30 A.M., 02:00 P.M. & 03:00 P.M. and seeks only one opportunity to do the needful, which may be even subject to costs, to which learned counsel for the respondent has no objection. 3.
