In pursuance to the said notification, in the meeting held by respondent No.5 dated 26.09.2025 the said direction has been accepted and the Board of Directors have resolved to refund an amount as has been directed vide notification dated 26.09.2025 (Annexure P-4).

Learned counsel appearing on behalf of the petitioner, which is Punjab Small Industries & Export Corporation Staff Association (Regd.) submits that the said refund will adversely effect the salary and the allowances admissible to the employees and therefore, the employees are within their jurisdiction to challenge the same so that, they do not suffer any prejudice. 4.

Mr. Jastej Singh, Addl. A.G.,Punjab, who is present in Court accepts notice on behalf of respondent Nos. 1 to 4 and Mr. Shubham Kaushik, Advocate accepts notice on behalf of respondent No.5.

Mr. Akshay Bhan, Senior Advocate assisted by Mr. Shubham Kaushik, Advocate on instructions from Harjeet Singh Sandhu, AMD, PSIEC submits that the apprehension of the petitioner that the refund of the amount in pursuance to the notification dated 26.09.2025 (Annexure P-4) will adversely effect the salaries or the admissible allowances to them under the Service conditions is

CWP-30412 of 2025(O&M) incorrect and the service conditions and emoluments to be paid to the employees, will be paid during their service according to their entitlement.

Learned counsel for the petitioner submits that keeping in view the statement of respondent No.5 on instructions from Harjeet Singh Sandhu, AMD, PSIEC, who is present in Court, no further grievance of the petitioner survives and the present petition may be disposed of as having been not pressed.
