The present petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in FIR No.246 dated 30.08.2023 under Sections 22/29-61-85 of the NDPS Act, registered at Police Station Tanda, District Hoshiarpur (Annexure P-1). 2.

Short reply by way of an affidavit of Mr. Kulwant Singh, PPS, Deputy Superintendent of Police, Sub-Division Tanda, Distt. Hoshiarpur has been filed by learned State counsel on behalf of respondent-State along with the FSL report in Court today, which is taken on record, subject to all just exceptions.

Vide order dated 19.12.2023, this Court while granting the concession of interim anticipatory bail directed the petitioner to join investigation.

Learned State counsel on instructions from ASI Gurmeet Singh submits that the petitioner has joined the investigation and his custodial interrogation is no longer required. 5.

In light of the above, the present petition is allowed. The order dated 19.12.2023 granting interim anticipatory bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.
