Instant petition has been filed under Section 528 of BNSS, seeking quashing of the below detailed First Information Report (FIR), and all the consequential proceedings arising therefrom, on the basis of the compromise dated 10.01.2025(Annexure P-2), effected between the parties. Vide order dated 08.01.2026, the affected parties were directed to appear before the learned Trial Court/Illaqa Magistrate, for getting their respective statements recorded with regard to the compromise. 3.
As per observations made by learned ACJM Panchkula, vide order dated 29.04.2022 in which accused namely Jagdish Chand has expirecd on 21.06.2021 and proceedings against has been dropped. In pursuance to the directions of this Court wherein, the factum of the compromise arrived at between
the parties stands verified and confirmed. As per the report(s) compromise has indeed been effected between the parties and the same is without any pressure or coercion and out of their free will and the private respondents have also made statement to the effect that they would have no objection if the FIR qua the accusedpetitioners is quashed. 4.

As per the statement of Investigating Officer, only 5 persons have been made accused, but as per order dated 22.11.2022 of charge, total seven persons were summoned as accused. However, accused- Jagdish Chand has expired. Further, it is clarified that all the victims including injured victims in FIR has also been arrayed as party in the present petition. 6.
Learned State counsel too submits that there are no other accused other than the petitioners and the private respondents are the only aggrieved person in the FIR in question.

In view of the report of the learned District & Sessions Judge, Panchkula, and the principles laid down by Hon'ble the Apex Court in Gian Singh Vs. State of Punjab and others (2012) 10 SCC 303, and also by the Full Bench of this Court in Kulwinder Singh and others Vs. State of Punjab and another, 2007(3) RCR (Criminal) 1052, the instant petition is allowed. The aforesaid FIR and all consequential proceedings arising out of it, are quashed. 8.
Needless to say the parties shall remain bound by the terms of compromise and their statements recorded before the Court below. 9.
Petition stands disposed of.
