Present Contempt Petition has been filed alleging violation of order dated 05.08.2025 (Annexure P1) passed in Civil Writ Petition No.198452025, whereby the Writ Petition was disposed of with a direction to the respondent No.2 to consider and decide the representations (Annexure P5 and P7) within a period of six weeks from the date of receipt of certified copy of the order after affording an opportunity of hearing to the petitioner. 2.

Learned counsel for the respondents has filed Compliance Report dated 02.02.2026 by way of affidavit of Naveen Kumar, Estate OfficerI, HSVP, Faridabad, which is taken on record. Copy of the same is supplied to the counsel opposite. Learned counsel submits that in compliance of the Writ

COCP-5107-2025 Page 2 of 3 Court Order, a speaking order dated 05.09.2024 (Annexure P4), has been duly passed.

It is further submitted by learned counsel for the respondents that interest upon delayed delivery of possession has already stand paid to the petitioner.

Learned counsel for the petitioner admits receipt of interest on the delayed delivery of possession. At this stage, learned counsel for the petitioner has referred to an order dated 26.11.2025 passed by a Co-ordinate Bench of this Court in COCP-5323-2025 titled as "Krishan Kumar Vs. Chander Shekhar Khare & Ors". It is submitted that in the said case, direction was issued to the respondents to deliver possession within ten days. 5.

Learned counsel for the respondents clarifies on instructions that delivery of possession to the petitioner was delayed on account of the fact that construction work in the vicinity of NCR Delhi was halted by the Hon'ble Supreme Court due to bad air quality. On instructions, it is undertaken that possession of the property shall be positively delivered to the petitioner within three months.

Learned counsel for the petitioner submits that in view of the undertaking of the learned counsel for the respondents, present petition may be disposed of.

Ordered accordingly. Needless to say, respondents shall be liable to pay interest to the petitioner, for the further delay in delivery of possession.
