Present petition has been filed under Section 483 of BNSS 2023 for grant of regular bail to the petitioner, in case FIR No.239 dated 12.10.2024 registered under sections 406, 420 (added later on 201, 467, 468, 471) IPC, registered at Police Station Guhla, District Kaithal. 2.

As per allegations against the petitioner by the complainant- Beant Singh is that for sending him to Canada complainant charged amount more than Rs.52,00,000/- but till date neither sent him abroad nor the amount is paid back. Petitioner is inside jail since period of 07 months and 18 days. There are serious allegations, as the facts narrated of status report reads as under:

6. That on 18.07.2025, production warrants of the petitioner were issued by the Hon'ble Court for 21.07.2025. Singh (complainant party) was obtained from 01.03.2024 to 20.04.2024 and according to the statement, rupees 23,02,547/- were transferred on 11.03.2024 and rupees 64,004/- were transferred on 14.03.2024 in the account petitioner through RTGS. Thereafter, statement of bank account number 65117873732 of complainant was obtained and from the perusal of the statement, it was found that rupees 4,00,000/- and 4,80,000/- were transferred in the account of petitioner on 15.04.2024 and rupees 1,00,000/- were found transferred in the account of petitioner on 18.04.2024. Thereafter, statement of bank account number 65117874237 of Satwant Singh son of Sahab Singh (complainant party) was obtained from 01.02.2024 to 15.05.2024. On the same day, statement of bank account number 1925001700059979 of petitioner was obtained from 01.02.2024 to 15.06.2024.

From the perusal of the bank statement of the petitioner, it was found that rupees 33,44,000/-were found deposited in the account of the petitioner from the complainant party on different dates. Besides that, petitioner has also grabbed rupees 20 lacs cash from the complainant party on pretext to send them abroad. Complainant is duped with huge amount for sending him aborad and till date no even substantial amount has been paid back. Dismissed at this stage.
