-.- Present application has been filed for reviewing the order dated 28.08.2024 passed in CWP-11581-2024.

Learned Senior counsel for the applicant-petitioner submits that while passing the order dated 28.08.2024, benefit of judgment passed in Union Territory of Chandigarh and others versus Central Administrative Tribunal, Chandigarh Bench and others 2011 (1) SCT 777 as well as judgment passed in Karam Singh versus Managing Director, National Health Mission and others 2022 (2) SCT 9 has been declined by the Co-ordinate Division Bench of this Court on the ground that the petitioner is a convicted employee whereas, the said fact is incorrect as no conviction has been ordered against the petitioner so far. Learned counsel for the respondents-UT has not been able to rebut the statement made by learned Senior Counsel for the petitioner recorded herein above.

Keeping in view the totality of fact, the wrong fact has been taken into account for consideration of the judgments passed in Union Territory of Chandigarh and others versus Central Administrative Tribunal, Chandigarh Bench and others 2011 (1) SCT 777 as well as in RIYA 2025.09.08 09:58 I attest to the accuracy and integrity of this document

RA-CW-141-2025 in/and CWP-11581-2024 (O&M) -2- Karam Singh versus Managing Director, National Health Mission and others 2022 (2) SCT 9 as to whether the same is applicable or not, the same will amount to incorrect fact apparent on record. That being so, the order dated 28.08.2024 is recalled and the main petition bearing CWP No. 11581 of 2024 is restored to its original number and status and the main writ petition is taken up today itself.
