***** ARCHANA PURI, J. (Oral) As observed in the previous order, despite service, the respondent did not make appearance, on that date. Even today, he has not made appearance. As such, respondent is proceeded against ex parte. Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/471/2025, titled 'Ajay Rana v/s Richa Rani', filed by the respondenthusband, pending in the Family Court, SBS Nagar and she seeks transfer of the same to the Court of competent jurisdiction at Hoshiarpur. At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 05.11.2023. After about fifteen days of the marriage, the respondent had gone to Germany and thereafter, he is not not in connection with the applicant, who was further compelled to leave the matrimonial house, on HIMANSHU VATS 2026.01.20 19:25 I attest to the accuracy and authenticity of this document

TA-1324-2025 account of the cruelty at the instance of the respondent and his family members on 24.05.2024. On account of matrimonial dispute, the applicant has already filed petition under Section 13 (1) (a) of the Hindu Marriage Act and the respondent has been proceeded against ex parte in the same. As a counter blast to the divorce petition, the petition under Section 9 of Hindu Marriage Act, has been filed. The applicant is not having any source of earning and is dependent upon her parents. The distance betweeen the two places is stated to be 67 kms.

In view of the constrained circumstances faced by the applicant as well as taking into consideration the fact of the respondent having not come forward to resist the transfer application, the same is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/471/2025, titled 'Ajay Rana v/s Richa Rani', filed by the respondent-husband, stands transferred from the Family Court, SBS Nagar, to the Court of competent jurisdiction at Hoshiarpur. The requisite record of the aforesaid case be sent by the Family Court, SBS Nagar, to the District and Sessions Judge, Hoshiarpur.

Learned District and Sessions Judge, Hoshiarpur, shall assign the said petition to the Family Court, Hoshiarpur. Even, the parties are directed to appear before the Family Court, Hoshiarpur, within a period of one month from today onwards.
